These Terms and Conditions (“Terms”) govern your use of the eLupiHaler app provided by Lupin. By downloading or using the app, you agree to comply with these Terms and our Privacy Policy.

1. Use of the Application

You agree to use the app only for its intended purposes, including:

  • Monitoring inhaler usage
  • Receiving alerts and reminders
  • Managing medication schedules
  • Syncing with smart devices
  • Communicating with your healthcare provider (if you choose to enable this feature)
  • Sharing your inhaler usage data with your physician, only with your consent

2. User Obligations

By using the app, you agree:

  • To provide accurate, complete, and current information
  • To keep your login credentials secure and not share your account
  • Not to use the app for illegal or unauthorized purposes
  • Not to tamper with the app’s functionality, code, or security features
  • To comply with all applicable laws and regulations
  • If you are a physician, you agree to use patient data solely for medical purposes and in compliance with privacy laws
  • Patients can revoke access to their data at any time through app settings

3. Permissions and Access

The app requires access to certain features on your mobile device to function properly:

  • Bluetooth: For device connectivity
  • Location: For weather-based alerts and air quality notifications
  • Notifications: To deliver reminders, health tips, and updates
  • SMS: To autofill OTP during login and verification

You may control or revoke these permissions anytime via your device settings.

Note: Disabling permissions may limit certain app features and functionality.

4. Physician-Patient Interaction and Data Sharing

The app allows patients to connect with physicians and share health data. Patients must give explicit consent before any data is shared.

Physicians must protect this data and use it only for treatment purposes. Misuse may result in account suspension or legal action.

5. Intellectual Property

All content, logos, graphics, designs, and software in the app are the property of Lupin or its licensors. You may not reproduce, distribute, modify, or use them for any commercial purpose without written permission from Lupin.

6. Limitation of Liability

Lupin is not liable for:

  • Incorrect or outdated data entered by users
  • Health outcomes resulting from misuse or non-use of the app or smart device
  • Temporary interruptions due to third-party services (e.g., weather or location data providers)
  • Device incompatibility, connectivity issues, or app malfunctions due to user-side factors
  • Loss or unauthorized access to data due to user negligence (e.g., sharing login credentials)

7. Disclaimers

The app provides supportive tools for inhaler usage and does not replace professional medical advice, diagnosis, or treatment. Always consult your doctor for health-related decisions.

8. Termination

We reserve the right to suspend or terminate your access to the app without prior notice if:

  • You violate these Terms
  • You misuse or tamper with the app
  • Continued access poses a security or legal risk

Upon termination, your access to data stored in the app may be discontinued.

9. Modifications to Terms

We may update these Terms at any time. Updated Terms will be posted within the app.

Continued use of the app after updates means you accept the new Terms.

10. Governing Law

These Terms are governed by and interpreted according to the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts located in Bengaluru, India.
